Terms of Service

SmarterApply is operated by an independent sole proprietor trading as SmarterApply.

These Terms govern your use of SmarterApply. By creating an account or using the service, you agree to these Terms.

1. The service

SmarterApply helps job seekers assess how well their professional profile matches a job opportunity.

You provide information such as a job description and CV or professional profile, and SmarterApply provides an analysis that may include a match score, identified requirements and an Apply, Adapt or Skip recommendation.

2. Important limitation

SmarterApply provides information to help you make your own decisions.

Its analyses and recommendations are not guarantees that you will or will not receive an interview, offer or employment. They are not legal, immigration, financial or professional advice.

Automated and AI-assisted analysis can be incomplete or incorrect. You remain responsible for deciding whether to apply for a position and for reviewing information before relying on it.

3. Your account

You are responsible for maintaining access to and security of your account.

You must be at least 18, or the age of majority in your jurisdiction, whichever is greater, to use SmarterApply.

4. Your content

You retain ownership of the CV, job information and other content you submit to SmarterApply.

You give us permission to process that content only as necessary to provide and operate the service.

You must have the right to submit any content you provide to SmarterApply.

We do not acquire ownership of your CV by processing it.

5. Plans, allowances and top-ups

SmarterApply offers free and paid plans with different analysis allowances and features. Current prices, allowances and features are displayed on our pricing and checkout pages.

Paid subscriptions renew automatically for each billing period until cancelled.

Analyses included with a subscription reset at the beginning of each billing cycle and do not roll over.

Additional analyses purchased separately as top-ups do not expire and remain available in your account across billing cycles until used.

We may change our plans or pricing from time to time. Any change affecting an existing subscription will be communicated before it takes effect and will not apply retroactively to a period already paid for.

6. Payments

Orders and payments are processed by Paddle, which acts as Merchant of Record for purchases made through SmarterApply.

Paddle is responsible for processing the transaction, payment methods, applicable taxes and related payment administration. Paddle’s applicable Buyer Terms also apply to purchases processed through Paddle.

7. Cancellation and refunds

You may cancel a paid subscription at any time. Cancellation prevents future renewal and your paid access continues until the end of the billing period already paid for.

Refund eligibility is described in our Refund and Cancellation Policy and is also subject to applicable law and Paddle’s applicable buyer terms.

8. Acceptable use

You may not:

• submit another person’s CV or personal information without their authorization;
• interfere with the security or operation of SmarterApply, or circumvent its usage limits; or
• use the service for unlawful purposes.

We may suspend or terminate access where these Terms are materially breached.

9. Availability

We aim to keep SmarterApply available and reliable, but we do not guarantee uninterrupted or error-free operation.

The service relies on third-party infrastructure and AI providers, and availability may occasionally be affected by maintenance, failures or circumstances outside our control.

10. Liability

SmarterApply’s analyses are informational tools designed to assist your own decision-making. We are not responsible for hiring decisions made by employers or for employment outcomes resulting from your use of the service.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, and your mandatory consumer rights remain unaffected.

11. Ending your account

You may cancel your subscription or delete your account through the service.

We may suspend or terminate an account for a material breach of these Terms or where necessary to protect the service or other users.

12. Changes

We may update these Terms from time to time. If a material change affects existing users, we will provide reasonable notice before it takes effect where required.
